Advocate Jagga writes to UT Health Secretary on Surrogacy (Regulation) Rules, 2022 in UT

Ajay Jagga , Adv Addl. Std Counsel, UT in a letter to Yashpal Garg, IAS Health Secretary, UT has requested for detailed instructions be sent to all concerned on the Surrogacy (Regulation) Rules, 2022 in UT.

Jagga wrote that the Government of India has recently notified the Surrogacy (Regulation) Rules 2022 which also mentioned the requirement and qualifications for persons employed at a registered surrogacy clinic besides the form and manner for registration and fee for a surrogacy clinic.

He added that for the successful implementation of the regulations, it is requested to consider that detailed instructions be sent to all concerned that as per the regulations; the Couples who intend to take the surrogacy route to become parents will have to buy a general health insurance coverage in favour of a surrogate mother for a period of 36 months. 

Further, the insurance amount should be sufficient enough to cover expenses for all complications arising out of the pregnancy and also postpartum delivery complications. The rules notified by the Union health ministry on June 21, has also restricted the number of attempts of any surrogacy procedure on the surrogate mother, i.e. three, he added.

Jagga said that the suggested step is for the protection of the surrogated mothers.
